These Terms and Conditions (“Terms”) govern your access to and use of kylerosetta.com (the “Site”). The Site is operated by Rosetta Educational Designs, LLC, a Washington limited liability company (“Company,” “we,” “us,” or “our”).
The Site describes consulting services offered by Kyle Rosetta through the Company under the name Rosetta Consulting. Rosetta Consulting is not a separate legal entity.
By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. Purpose of the Site
The Site provides information about Kyle Rosetta, his writing, and consulting services offered through the Company. It may also provide links to Rosetta Marketing Designs, Faith in the Fire, and other websites, businesses, services, or resources.
These Terms apply only to kylerosetta.com. Other websites may be governed by their own terms and privacy policies.
2. Informational Content
Content on the Site is provided for general informational and educational purposes. It reflects the author’s experience, opinions, and perspective and is not a substitute for advice tailored to your circumstances.

A consulting relationship begins only when the Company and the client enter into a separate written agreement.
Consulting services, including scope, deliverables, fees, payment terms, cancellation terms, confidentiality, intellectual-property rights, and responsibilities, are governed by the applicable written agreement. If that agreement conflicts with these Terms, the written consulting agreement controls with respect to those services.
Information presented on the Site is an invitation to inquire and does not obligate the Company to accept an engagement.
4. No Guarantee of Results
The Site may discuss client work, business situations, strategies, systems, or outcomes. These examples are provided to explain ideas and approaches. They do not guarantee that another person or business will achieve the same or similar results.
Any decision you make based on information from the Site is made at your own discretion and risk.
5. Intellectual Property
Unless otherwise stated, the Site and its original content—including articles, text, graphics, photographs, videos, downloads, branding, page designs, and other materials—are owned by or licensed to Rosetta Educational Designs, LLC and are protected by applicable intellectual-property laws.
You may view, download, or print Site content for your personal, noncommercial use. You may also share links to publicly available pages.

We may restrict or terminate access to the Site when we reasonably believe these Terms have been violated or the Site is being misused.

To the fullest extent permitted by law, Rosetta Educational Designs, LLC, Kyle Rosetta, and the Company’s members, employees, contractors, representatives, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to:
Your use of or inability to use the Site
Your reliance on Site content
Errors, omissions, interruptions, or security incidents
Third-party websites, tools, or services
Decisions or actions taken based on information found on the Site
This limitation does not apply to liability that cannot legally be limited or excluded.
12. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Rosetta Educational Designs, LLC, Kyle Rosetta, and the Company’s members, employees, contractors, and representatives from claims, liabilities, damages, losses, and reasonable expenses arising from your unlawful misuse of the Site, your violation of these Terms, or your infringement of another person’s rights.

15. Governing Law and Venue
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles.
Any dispute arising solely from the use of the Site will be brought in the state courts located in Whatcom County, Washington, or the federal courts serving that county, unless applicable law requires otherwise.
Disputes arising from consulting services will be handled according to the applicable written consulting agreement.
16. Severability and Waiver
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect. The invalid provision will be interpreted or modified only to the extent necessary to make it enforceable.
Our failure to enforce a provision of these Terms does not waive our right to enforce it later.
17. Entire Agreement
These Terms and the Privacy Policy constitute the agreement governing use of the Site. They do not replace or modify a separate written agreement for consulting or other services.
